Definition of Major Application

We are having a debate as to whether a change of use of over 1,000sqm of floorspace is a major application. The DMPO definition includes "the provision of a building or buildings where the floor space to be created by thedevelopment is 1,000 square metres or more" and there is an argument that this would include a change of use, specifically as it states provision rather than construction or erection of a building. Any views?

I agree it could be more explicit but I've always understood change of use of over 1000 sqm to be a major. 

The change of use *is* the development.

I've asked the DCLG and got the following response, which I translated to mean that changes of use are not major development unless on a site of over 1ha:

"The statistician has asked me to refer you to the following guidance (the most relevant part shaded in red), from page 13 of the PS1/2 guidance notes at  https://www.gov.uk/government/publications/district-planning-matters-return-ps1-and-ps2:

 

“Major developments - definition

For district matter applications, ‘major development’ means development involving any one or more of the following;

  • The provision of dwelling houses where –

o The number of dwelling houses to be provided is 10 or more: or

o The development is to be carried out on a site having an area of 0.5 hectares or more and it is not known whether the number of dwelling houses to be provided is 10 or more.

  • The provision of a building or buildings where the floor space to be created by the development is 1000 square metres or more: or
  • Development carried out on a site having an area of one hectare or more;

 

Where a site above one hectare is subject to a change of use application, it should be coded under major development and not as a change of use (Question 20). Any other applications for change of use should be captured under Question 20 and not under the relevant major/minor development category.”

What about change of use to 1 new dwelling on a site of 1.5 hectares?

I think a lot of Councils would treat it as a major application (maybe even most). But, at the risk of assuming a modicum of common sense in the drafting of SIs, if COU was intended to be included why wouldn't it just say 'development where the floor space exceeds' rather than 'provision of a building'? It does seem like a logical decision to exclude COUs from the definition. You would need to use the same logic for 'provision of' 10+ dwellinghouses too, though. 

If you prefer to call it a major (maybe you want 13 weeks to deal with it, or it'll help with the stats, or you've got a press ad fetish), why not? It's probably the least risky approach. The only people who might care about you 'upgrading' it are the PS1/PS2 monkeys at CLG and they're not checking anything other than whether the numbers look pretty. I would do whatever feels right to you, but it's probably a good idea to be consistent.
