Can you Appeal a re-submission?

Hello.

An appeal was submitted after an initial outline planning for the subdivision of the existing residential garden, including the erection of a detached two storey three bedroom dwelling, with all matters reserved, was refused on the grounds of noise levels.

 

The appeal was dismissed.

 

We re-submitted within a year for a one storey two bedroom dwelling with all matters reserved.

This second application went to committee and was refused on the grounds of noise levels,  and that is would reduce the area's verdant street scene,  and also that it was outside the development area (although at appeal on the first submission it was agreed that this was not enough to refuse permission as it was on the very outskirts of the boundary.) 

We have a solution to the verdant problem and also have ammunition to cover the development area and can get a new noise assessment carried out in a new location on the same site which should come back with noise levels in range.

 

My question is - "Can we make an appeal on a re-submission?" as I am lead to believe it is classed as new application in its own right.
