I've got an issue with some Structure Plan policies that 1) Have been saved through the RSS process 2) Will cease to apply when the RSS is revoked But are listed as 'replaced' in the District Core Strategy by policies which cover similar ground. I am not clear that it is within a District's powers to cease to apply a strategic policy unilaterally. To me the logical approach is that both SP and CS policies remain part of the Development Plan but in the event of a conflict CS policies (or NPPF) take precedence.

Saved SP Policies remain until they are revoked by the Secretary of State. In relation to the revocation of the SE Plan the Sec of State is continuing to keep an Oxfordshire SP policy extant.
