Thank you for the link to the full judgement Those who say this will only last until the Decentralism and localism Bill has royal assent have clearly not read the decision. There were two grounds of appeal – one of which related to Strategic Environmental Assessment. Not SEAing the cross border implications of revoking RSSs. Even primary legisaltion will not remove the need for strategic SEAs and consultation on them as required by european law. Even an appeal would go past the supreme court all the way to the european court of justice. I predicted such a successful legal challenge in May in my planning article price of reform. Local authorities persuing core strategy submissions and developers persuing allocations need to take certain key steps – and frankly ignore the poor, unlawful advice of the Dept. But presumably the Localism and Decentralisation Bill will have an SEA. So Regional Strategies will remain until the Bill is enacted - admittedly this could take more time to ensure an SEA is undertaken.
