Planning Condition and Trees

This is a fairly standard condition often attached to planning permissions - "no trees on the application site shall be lopped, topped or felled and no shrubs or hedges, shall be removed, without the approval in writing by the Planning Authority".  I wish to lop overhanging branches from 2 trees, and have been advised to submit a full application to VARY this condition!  Can anyone explain what element of the condition I would be varying?

You say 'overhanging', if the overganging braches are not within the application site, then I would have thought that you'd be quite at liberty to carry out these works without the need for any formal consent, unless of course the trees are protected by virtue of a TPO or being sited within a conservatin area.

Paul.  My fault, not enough information!  The 2 trees in question are within the application site, so are covered by the condition.  They are overhanging the garden of one of the approved houses.  My question is about the procedure needed to have the Council's approval to the works.  I think a simple letter requesting approval is all that is required.  The Council are requesting a S42 application (that would be S73 in Englnad I think) to vary the condition.  Mike
