Has any charging authority accepted a payment in kind application and finalised through a legal agreement?
When should the legal agreement be signed particularly with regard to an outline application/permission where the transfer of land within the site in lieu of CIL (and is to be used for 123 list infrastructure) is pertinent to the design and capacity of the scheme as a whole, but where liability will not start until the last reserved matter has been approved? If the legal transfer agreement cannot be finalised until liability arises - what other mechanisms can be used, at determination stage, to provide certainty that the land will be eventually be transferred to or will be accepted by the charging authority/nominated party? Any thoughts appreciated.
