Some one has laid a new driveway, without planning permission, that is not permeable and has failed to provide some form of sustainable drainage to prevent surface water passing onto the highway they have not had regard to potential flood risk.

The driveway is steep and then there is a fairly steep road so surface water would easily pass onto the highway.

We approached the owner of a property across the road that had the same issue and they put in drainage however these people are really dragging their heels.

As drainage is in the GDO would anyone or has anyone issued a 330, and if your did or would, would you consider an enforcement notice? Also would we be required to evidence how we have come to consideration that the lack of drainage would cause a flood risk and how high would that risk be?

Also as the only issue is potential flood risk. If the enforcement was appealed against how likely would their appeal be successful as the flood risk would be the only point of argument?

Any help would be much appreciated. Thanks.
