Hi All,

It is my understanding of the CIL Guidelines that floorspace accessed by a staircase is included in the internal floorspace calculation but that floorspace accessed by a loft ladder is not.

If my understanding is correct, would I then be correct in saying that if an applicant is erecting a two storey extension and replacing a loft ladder with a new staircase to the loft space my CIL calculation should be the floor area of the extension and the floor area of the loft as the new staircase is making it into habitable space??

Your views would be greatly appreciated.

It's how we would do it if that helps.

Having said that, the applicant is likely to claim self-build exemption, which raises another issue that we still have to get to grips with, ie. how do you monitor exemptions to ensure a disqualifying event doesn't occur?

There are no disqualifying events in relation to residential extensions, only residential annexes and new self-build dwellings.

Sorry to bring bad news but the regulations are contradictory on this issue.

Reg 42 withdraws the excemption if the applicant does not serve a Commencement Notice Prior to the commencencement however Regulation 67 (1A) (aa) states a commencement notice is not need for residential extensions.

As CIL liability will be placed on land charges it would be prudent to advise that Commencement Notices should be sent to the authority regardless.

Of course this will this will be corrected along with all the other issues that have been hightlighted in these forums when the new regs come out.
