I understand that this is the position: Neighbourhood plans are part of the development plan (see the amendments to s38 of the 2004 Act made by paragraph 6 of Schedule 9 to the Localism Act) and as can be seen from these amendments they are listed separately from DPDs in the list of items that make up the development plan. NPs are not development plan documents. DPDs are defined in s37(3) of the 2004 Act as a local development document specified as a DPD in the local development scheme. The LDS is the programme the local planning authority agrees for bringing forward planning policies in its area. The LDS only includes documents created by the local planning authority. The distinction is important is important because SA only applies to DPDs not NPs - although SEA will still apply

Hi Alice,

 

Could you tell me when the LPAs should carry out the screening report to ascertain whether a SEA/SA and HRA is needed? It is my understanding that this should be carried out relatively early in the neighbourhood plan development, given that if a need is identified, it should be used to inform and guide the reasonable alternatives of the plan.
