We have just started to charge monitoring fees on s106 agreements, late to the party, I know!..
We have a set fee per clause, but I have just been sent a new clause for monitoring a BEMP (biodiversity enhancement management plan). This is going to require much more intensive monitoring than all other standard clauses. The habitats will need to be developed and maintained over 30 years, therefore will require LPA monitoring after 1,2,5,10,20 and 30 years. Plus input no doubt from an ecologist if defects are found.
How have other authorities dealt with this? Have you included the management of biodiversity net gain as a larger set of clauses in the S106, or has a separate financial instrument been created to deal with the potential financial costs etc.?
