Havant Borough Council planning authority said at pre-app " There may be a requirement for a contribution to the County Council Transport Strategy of £3745 [for one dwelling] secured by a legal agreement, depending on when the site was last occupied." I have two questions 1) What difference does it make when the site was last occupied (it has been unoccupied since 2008)? 2) The application is likely to bump into the Councils CIL (comes into force 1st August 2013). This says £100/sqm x 178sqm dwelling = £17,800 - big difference, which figure would apply?

It is difficult to answer without further details and so I would suggest asking Havant as this is a site specific query. CIL will be liable on any net increase in floorspace for development granted permission after they adopt CIL. In terms of what they spend it on, and what they can still charge s106 for, you will need to refer to their CIL regulation 123 list. Vacancy is also an issue with CIL - you need to check out jhow CIl is calculated in Regulation 40 ( near the end) for the details of when an exisiting building is liable for CIL.
