NPPF and regional policies

Para 218 does not allow you to 'save' RSS policies. What you are doing is putting them into your plan, provided there is appropriate robust evidence. Whether you have an adopted or emerging plan, the basic process is the same. Support it with evidence and ensure proper engagement on it. If your plan is adopted, this will fall under the 'partial review' (as stated in 218). You would also use a partial review to make changes to an adopted plan where monitoring/evidence indicates changes should be made. If your plan is emerging, you need to ensure there has been appropriate engagement on the issue. Even if you use the exact same wording, you will need to engage and support with evidence. You could produce some kind of interim policy statement, but it won't be part of the development plan. So, use 218 and get on with it.

The evidence prepared for the SEA of the policies/proposals of the regional strategy may still be relevant and up to date and have been consulted on forest heath/greater norwich compliantly - so if those are included in the partial review you might not have to do much work. However if they did not consider and consult on reasonable alternative sites then you may have to carry out new consultation and SEA under the duty to cooperate. In most cases however the RSS would have already been challenged and paras struck out on this point (Oxford, Hemel Hampstead, Woking, Hatfield).
