We are preparing our Sites and Policies DPD and are looking to introduce a policy on hot food takeaways. I am aware of other LPAs introducing policies and SPDs on this topic. We have previously classed A5 takeaways as main town centre uses to which the sequential approach in NPPF applies. However development management colleagues have recently queried this approach given that NPPF does not specifically mention takeaways in the definition of main town centre uses.

It refers to "...the more intensive sport and recreation uses (including cinemas, restaurants, drive-through restaurants, bars and pubs, night-clubs, casinos, health and fitness centres, indoor bowling centres, and bingo halls);

My view is that the definition refers to 'including' and does not say 'only', and in practice takeaways can be as intensive a use as some restaurants at times.

I wonder if anyone else has considered this issue or has views on whether the sequential approach should apply, as this will influence drafting of the policy.
