&lt;p&gt;I recognise that there can't be any legal absolutes for amenities just because they're funded by S106, but does its provenance infer any additional consideration for the planning officer? I have to say I'm always slightly concerned when&amp;nbsp;an LPA's own&amp;nbsp;land is going through the planning process as it feels too much like marking your own homework.&lt;/p&gt;</summary>

    <summary type="html">&lt;p&gt;Hi Steve, re your overall question, 'can they do that?' , sometimes yes, sometimes no, it's rarely straightforwards&lt;/p&gt;

&lt;p&gt;You should be able to freely view a copy of the S106 with your local council - although you may have to file a request with them and perhaps pay if you want a copy made/printed&amp;nbsp;- different council's have different admin processes but fundamentally there is a requirement for them to show you this&lt;/p&gt;

&lt;p&gt;Just to manage&amp;nbsp;expectations though, S106 agreements only rarely place restrictions on the council that would be relevant to your situation, but you should still check because this could be the exception&lt;/p&gt;

&lt;p&gt;Can a public greenspace purchased by the LPA with S106 funds be sold 20 years later to a developer? The funding for maintenance has been gradually withdrawn and has now ceased entirely, so local volunteers have to do everything. I'd like to access the original S106 agreement - how should I go about this?&lt;/p&gt;
