Ideally the negotiation would negate the need to appeal but obviously timescales could mean the appeal needs to be lodged. <p>Please can anyone with knowledge of the Law explain whether, if you appeal against a Refused (by LPA) planning application, you obviate your opportunity for a "Free Go" in terms of the fees payable for a similar planning application until the Appeal is decided.</p>

<p>I ask as there is nothing explicit (positive or negative) within the regs to guide me.</p>
<p> </p>
<p>I know that the 12 months for a "Free Go" can run from the date of refusal by either party (LPA or Inspector), but does the fact that an Appeal is "in" <u>prevent </u>a "Free Go" in the meantime?</p>
