    <summary type="html">No, you can appeal and then still negotiate and resubmit as your free go. Ideally the negotiation would negate the need to appeal but obviously timescales could mean the appeal needs to be lodged. &amp;nbsp;</summary>

&lt;p&gt;Please can&amp;nbsp;anyone with knowledge of the Law explain whether, if you appeal against a Refused (by LPA) planning application, you obviate your opportunity for a "Free Go" in terms of the fees payable&amp;nbsp;for a similar planning application&amp;nbsp;until the Appeal is decided.&lt;/p&gt;

&lt;p&gt;&amp;nbsp;&lt;/p&gt;

&lt;p&gt;I ask as there is nothing explicit (positive or negative) within the&amp;nbsp;regs to guide me.&lt;/p&gt;

&lt;p&gt;&amp;nbsp;&lt;/p&gt;

&lt;p&gt;I know that the 12 months for a "Free Go" can run from the date of refusal by either party (LPA or Inspector), but does the fact that an Appeal is "in" &lt;u&gt;prevent &lt;/u&gt;a "Free Go" in the meantime?&lt;/p&gt;
