CIL Self Build Exemption Stage 2 - ownership query

Hi All, 

I am unable toi find specific legislation where a self builer requesting exemption has to be land owner. Although they have to comply with not selling the house or rent it out for at least 3 years after building control compliance certificate issue date. I was wondering if anyone else come accross this. Any help to clarify this is much appreciated.

Hi,

You need to look at both CIL reg 54C 3.c the documents to be supplied at the completion of the development and the evidence required in form 7 part 2.

The regulations impose the burden of supplying information in line with the form published by the Secretary of State.

The form requires the applicant to supply the evidence as directed. Land reg document in this case.


When read together this underlines that the individual claiming must be the land owner at the completion point.
