Hi All

I'm not a planner, so forgive me my ignorance, my role is data protection/FOI and EIR.

I find myself looking at The Town and Country Planning (Development Management Procedure) (England) Order 2015 A40(2) which says:

Each local planning register authority must keep, in two parts, a register (“the register”) of every application for planning permission relating to their area.

Does "every application" include even invalid ones? To my lay mans mind "every" is so broad I believe it must, but I'm aware that statute could determine that an application is only an application when it is valid.

The approach that I've always adopted is that its not formally an application until it is "valid", and that includes the correct fee being paid.

Have a look at Articles 7 and 11 of that legislation. They set out the criteria applications need to fulfill before they are considered valid. You wouldn't include an application in the Planning Register until that had happened.

So for example, applicants need to have paid the fee and provided the relevant application form, plans etc.
