Although we cant find anything in the 2012 Fee regs which specifically relates to this, is it legally necessary to submit a fee to discharge a condition, where PD rights have been removed on the property and the parent application was exempt from a fee? Sounds a bit harsh that they might need to pay , but as I said can find anythin specific in the regs.
Any pointers welcome.
It is not legally necessary to pay a fee to discharge a condition. It's at the discretion of the LPA. Personally I think whether you decide to charge should depend on the amount of work involved rather than whether the original app was fee exempt. But there is also the question of whether the applicant was offered an opportunity to provide the relevant details before a decision was issued.
