S106 payments for school places
Hi everybody. Generally, S106 payments for extra school places is founded upon the local school not having capacity i.e no spare places now, or a future projected deficit, or if there is a some capacity, this would be all used up & exceeded as a consequence of the development going ahead. A 2002 Audit Commission report says a perfect match of pupils and school places is unrealistic and probably undesirable,and suggests schools need a margin of surplus capacity. So where the local school only has a 'small' surplus of places, it might be reasonable to seek S106 payments so a margin is kept, even if spare capacity isn't all used up. Does anyone operate in this way? If so what do you use as a reasonable margin of surplus capacity. Can anyone assist? Nigel Moore

We tried this within the last year or so using 10% of total places as the margin (on the basis of DfE advice re. parental choice I believe) but the developer would not accept the justification put foward so s106 only addressed deficit arising from the development. Jackie Palmer
