Hello to all,

We are looking to submit a prior approval via the online planning portal, however, upon completing the criteria we've been given this notice: "Not eligible - You have stated that the proposals will exceed limits set by legislation. You should not continue with this application and seek advice from your Local Planning Authority on the best course of action."

The prospective plans are to change a warehouse to an indoor sports facility and the indoor space is approximately 2,000sqmtr. The current use is a clothing factory, however, from what can be seen online the original use is deemed as a agricultural.

Any advise here would be highly appreciated.

If the development exceeds the limits for the specific relevant permitted development right (in this case I'm assuming: https://www.legislation.gov.uk/uksi/2015/596/schedule/2/part/3/crossheading/class-r-agricultural-buildings-to-a-flexible-commercial-use ) then you can still apply, but it would likely require full planning permission rather than prior approval.

However, as per the advice, it would be worthwhile engaging the local authority (informally or via their pre-application service) or a planning professional to try to determine the best way forward, particularly if there is a question over what the current use is deemed to be.
