Incorrect date on CIL commencement notice on self build development.
We have a self build applicaiton where they have submitted a commencement notice, so in theory all good so far.
As part of our regular monitoring we can't find any indication that they have actually started (and yes, that included a site visit to go look). Their commencement date was over a year ago so it's not just a few days out.
The wording on form 6 says
if the intended date of commencement changes, failure to notify the CIL collecting authority before development commences of this date with a new commencement notice will result in the CIL amount being due for payment in full on the date of commencement.
So for a paid developement this is prety clear what the penality is. But as it doesn't disqualify the relief and the full amount is zero I'm not 100% sure what penality there is if they don't update the form. The best I can come up with is it's not a valid commencement notice as the date's wrong so that's 20% of the amount without relief. Is that correct?
The practical approach is that I'm going to write to them to get them and explain the situation hopefully it will get resolved without surcharges or hassle but I'd like to know where I stand before sending that email.
