New pathway next to bathroom window - Public forum - Planning Advisory Service (PAS)

My elderly female (single) neighbour is in rented accomodation and is desparate need of help.

the landlord is seeking to build a new property and wants to use her private path as access to the rear. Her bathroom window would be at eye level to any passers by. She has a gagging order which prohibits her from objecting.

the new pathway (currently private) will be open (only) to residents of the new building.

is this legal? It seems like an infringement of rights to me.
