CIL- Aggregate Development

If two planning applications were submitted on the same day for the same property and collectively they were over the 100m2 threshold but as separate applications they fall under the threshold could the development be liable for CIL?

Hi Emma I can't recall the document in question but I have read somebody's PDCS or DCS (perhaps even their web page on CIL) which stated that where a clear deliberate attempt had been made to circumnavigate the CIL liability the application would be refused? Not sure if this qualifies as a reason for refusal in accordance with the Regulations though? Points to consider: Would both applications potentially be capable of being built out on the site together? Is each application being submitted by the same applicant? Has the applicant provided any reason for submitting two separate applications?

The same issues will presumably arise if part of a proposal is taken forward as "permitted development" with a floor area of ljust less than 100sq m and at the same time a planning permisison implemented which is also just less than the 100sq m.
