Please find attached a series of documents prepared by Defra in response to queries raised during the recent Capacity Building Workshops on the transfer of s23 consenting powers to Lead Local Flood Authorities. Included is a Q &A compiled from the various questions asked at the Workshops, a factsheet explaining the transitional arrangements for s23 consents and for s24 and 25 powers, a copy of the Advice Note sent to Environment Agency Development and Flood Risk Teams concerning the transfer of records to LLFAs a set of model land drainage byelaws, together with a list of those local authority that have already adopted them. The model byelaws will shortly be published on Defra’s website ( http://www.defra.gov.uk/environment/flooding/information-for-practitioners/ ) along with updated guidance on the various steps to making a byelaw.
