If we are securing a heathland mitigation project through a S106 agreement, can we include monitoring of the impact & effectiveness of that project in the S106 agreement? We are having a discussion internally as to whether we can ask for monitoring.There is a view that by requiring monitoring we are suggesting that we're not sure whether it will have the impact required and if we think 'it' may not acheive what we want it to, we should not be asking for 'it'. Other LA views are that we expect monitoring of other projects secured through S106, so why not heathland mitigation? Any guidance greatfully received. Thanks.
