Sui Generis and planning permission
Hi all. When does Change of Use within Sui Generis not require planning permission?
When the new use is not materially different to the existing Sui Generis use if consider also to be Sui Generis.
However, as the Sui use class is considered to be "of its own kind" then this would be a very short list.
Sui generis is NOT a Use Class - it is a desriptor of assorted uses that do not fit in any Class whatsoever
But as ever the real question is whether the proposed change of use from A to B appears to be a material change of use within the meaning of S55 of the Act
