Hello,

Where a group TPO exists, could intentional neglect of the land the trees are on be classed as an offence? There are probably several ways this could happen, such as allowing severe poaching from livestock around the tree, or letting a drainage ditch become clogged so the area is liable to flooding which could kill trees. In a case I'm considering, a plum orchard covered by a TPO is being allowed to become very overgrown. Neither the trees nor sward are being managed appropriately, so they are shedding limbs and being shaded out.

In all of these scenarios the TPO'd trees would ultimately be killed off prematurely. Would there be a case for enforcement action?
