Caravan to cabin

Evening.

I have a lawful development certificate for a caravan in my garden to be used as ancillary accommodation to the main house. Am I able to replace the caravan with a cabin or would I need another LDC. Any advice gratefully appreciated.

I assume you mean you have a caravan probably with wheels and capable of being towed around the site 

I also gather that the council have already accepted via the certificate of layfulness that it is within your curtalage and so long as you use it as ancillary and don't rent it out it is legal

 

You can if you wish change it at any time for a newer caravan

the definition of a caravan is quite strict and can have no internal part with more than 10ft headroom 

the Definition is available and readable in hansard

you replacement must comply with this definition

The Definition states it must be posdible to move is round your site and move is from site to site in a suitably adapted vehicle 

there is a major disagreement as to whether this means a sledge type construction is acarptable or dos it need wheels 

i would always recommend using wheels to avoid any argumemts

there is nothing to stop you having a lodge on wheels even in two harves 

but it must not be an immovable lodge

Replacing a caravan for another is OK because the ancillary use continues albeit in a new caravan. Replacing the caravan with a cabin would also be OK provided the cabin is moveable as a whole. If it would be fixed to the ground by way of foundations and other means, even if it has wheels, the cabin might be deemed as consituting a "building" for planning purposes.

The cabin would be built on site and have a structural engineer report to stare it could be lifted with a crane. Or arrive on 2 lorries in 2 halves. It would be significantly bigger than what is already there

I think it's worth asking the Council for a formal opinion. It sounds like the cabin would not fall within the scope of your LDC even if you use it for ancillary purposes. A caravan can arrive in 2 halves and fixed on site but such work does not require structural engineer. Additionally, the structure should be moveable as a whole. It's entirely your call but I'd double check to save problems later on.

If you are wanting to rely on the lawful development certificate for an alternative then you should check the 'red edge' of that certificate (on the location plan). Is it is drawn tightly around the current caravan or is it around the curtilage of the dwelling? If the former and the replacement is significantly bigger then I doubt it would cover a larger caravan. If it is around the curtilage it would cover a larger caravan (as long as it fell within the definition) to be placed anywhere in the certificate red edge.
