We have a case where the CIL liability has been settled in full and the CIL charge has now ceased to be a local land charge (CIL Regulation 66(1) (2)).
However the development is continuing to be built out, and the developer has now applied for a variation of condition involving changes to house types. This will result in a reduced floorspace, and therefore, a reduced CIL liability. Is the Council able to refund a proportion of the CIL payment at this stage, and if so, by what process?
Any advice would be appreciated.
