Can anyone advise please? Our Council passed a Cabinet Decision to implement a S.106 Agreement. The S.106 Agreement has been displayed on the Council's website but has had a page "missing" since it was deposited in 2009. Just recently the Council has decided to sell some land which was ordered by the Cabinet Decision notice to go back to public open space in the S.106 Agreement. On finding an incomplete S.106 Agreement on the Council's planning file web site, further investigation discovered the Decision Notice to put the land back to public open space had not been included by the council officer. That same officer is now taking the Council towards concluding a deal with a the developer of the original planning application to sell him more of the land which, it turns out, he "left out" of the S.106. Can someone advise?
