End of Scheme Appraisal - Affordable Housing contributions

Have any members entered into "End of Scheme Appraisal" arrangements which have been put into place because the provision of Affordable housing on-site was not viable at the commencement of Development. We are looking for a precedent for addition to a S106 agreement whereby at the end of the Scheme the development profits would be calculated on an open book basis, and the Council would receive a payment of 50% of all profits above a certain level to have affordable housing constructed on anopther site in a radius of the development. Effectively the Council is looking for a share of the profits arising from increases in land value, affordable housing not having been provided on-site in accordance with current policy. Many thanks

I attended a seminar at Bristol City a couple of years ago. This was based on an RTPI initiated discussion on the potential need to review s106 agreements. Bristol were planning to introduce a policy that would allow for some sort of clawback mechanism based on a viability assessment of stalled developments. It might be worth giving them a call to see if it worked.

Plymouth CC has used a number of review mechanisms to claw back affordable housing contributions, whether they are offsight contributions or additional on-site units. Experience has shown the importance of achieving a balance between the detail required to adequately assess viability and the practical ease of implementing the mechanism. Everything becomes easier if the relationship between developer and lpa is congenial. In other words, the best solutions come out of mutual construction. Happy to talk further..give us a call.
