Indemnity insurance against breach of 106 agreement
Where such a breach has occured, can indemnity insurance be obtained by the seller and offered to the buyer and their lender? For example, if a garage has been converted in breach of a 106 agreement, can the seller use an indemnity insrance policy to cover the breach and if so, to what extent will this be acceptable to the LPA and mortgage lender?
