Protocol for appeals following member overturns
Does anyone have any written protocols on how appeals are to be dealt with following member overturns of officer recommendations? In particular we are looking at clearly establishing the roles of officers and members in producing statements and appearing at inquiries.
We do. We had a situation recently where two members of our planning Committee represented the council at an informal hearing appeal for a proposed block of flats, which had been refused contrary to recommendation. The hearing did not go well but the two members put the blame squarely on the case officer who attended the appeal to help the members prepare their case. As a result a formal protocol was devised and the Planning Committee did subsequently approve and adopt this protocol (copy attached with copy of Committee report) I hope it helps.
