I have a client who wishes to alter the position of windows on the front elevation of a consented scheme. The LPA has agreed the alterations, but will not permit them as a minor amendment. They instead wish to see a full planning application. The application was rather contentious, though the elevational appearance wasn't. I am of the thought that the amendment could be bought about by submitting a S73 to vary the condition in accordance with submitted detail, but the LPA won't countenance. There is support in CABE guidance and in PINS advice to Inspectors to allow variations to schemes via specific conditions. This is a generalised materials conditions, but all the scheme wishes to do is alter the disposition of materials on a single facade What do we think?
