HMO - more than 6 occupants

Hi Does any one know where a LA stands if a property has more than 6 occupants? Is there a use class that covers this, if not then how does planning control them? Thanks Jagdeep Birk

Re: HMO - more than 6 occupants

HMOs with more than 6 persons sharing are not classified under the Use Classes Order, they are "sui generis", that is, a use which does not fall into any of the categories defined within the Town and Country Planning (Use Classes) Order 1987, as amended. For further clarification you may care to look at Circular 05/2010; http://www.communities.gov.uk/publications/planningandbuilding/circulardwellinghouses
