We have a client who wishes to undertake a rear extension. This is a gable extension where the roof will be set below the level to the roof of the original dwelling but at the same pitch. I am happy that the proposal will meet the requirments of Class A - particularly as it will not be caught by A.1(i)(iv). However an issue arises that the extension is to include a dormer in the side elevation. In isolation this would meet the requirements of Part B, but clearly if the building work were carried out as a single operation there is an argument to say that taken together the extension falls outside Class A. Indeed the LPA could even argue that the resulting roof space would exceed 50 cu m. What is the best way of dealing with this as clearly it would be preferable to make a single application for a Certificate of Lawful Development. Would a note on the plans to clarify that the work consists of two separate elements be sufficient. Any advice or recommendations - please.
