Old Planning Permission
I've just come across a planning permission dated 22 March 1967 that only has one condition on it, and that relates to the drainage arrangements. As there is no time limit for commencement, does that mean it is still 'live'?
I think I've just answered my own question! Section 66(1) of the Town and Country Planning (Scotland) Act 1969 [or S65 of the 1868 Act if it were in England] introduced a provision under which planning permissions granted before 8 December 1969 would lapse on 9 December 1974 if the development had not begun by that date. As it happens it looks as though my permission was begun in 1968, when the access road, drains, water supply and foundations were all completed. Isn't planning brilliant!
