Planning obligations

Does anyone know the answer to how we can provide for planning obligations where we have applied for outline permission for our own land. We want to sell with permission and some elements will be covered by conditions but clearly we cannot covenant with ourselves. Providing for them in the sale agreement is not being recommended by our outside conveyancer. Thanks in anticipation.

Obligations & selling own land with permission

Hi Hywel. You might want to check this out with your Legal services but here we use a planning condition: Unless otherwise agreed in writing by the Local Planning Authority, no works shall be carried out under this planning permission unless and until all parties with any legal or equitable interest in the land comprising the application site have entered into an Agreement pursuant to Section 106 of the Town and Country Planning Act 1990 in the terms set out in the proposed Section 106 Agreement annexed to this permission, and the title to such land has been properly deduced to the Council. & then attach to the decision notice a draft S106 Agreement ready for completion/signing

Thanks Nigel. Sorry I've been slow in acknowledging. Yes, we'll probably go with that suggestion and also tie the sale to the purchaser delivering up on completion a completed and signed agreement/undertaking in respect of the contributions.
