CIL and Section 38/278 Agreements

Hi I know that from 2014 S.106 can no longer be used (except for affordable housing) and CIL will effectively replace section 106 agreements. However, does anyone know whether Section 38 and Section 278 Agreements (for transport) will also be replaced by CIL or can these continue regardless of whether or not a CIL charging schedule is in place? s106 will still be able to be used provided the tests in the CIL regs are met and no more than 5 contributions are pooled for one project or type of infrastructure. CIL and the changes to s106 do not affect either s 38 or s278 of the Highways Act these can still be used where appropriate. Hope this helps Gilian
