CIL Software

We are starting to make admin arrangements for the introduction of CIL, and I wondered if anyone had any recommendations with regard to software - either for systems themselves or useful features we should be looking at including on our product specification. Thank you for your help.

I work for Lambeth and we use Exacom's CIL Administrator. We are happy with it. Below is a summary of the specification that we have set out prior to procurement:: Interface with Uniform Planning software to obtain CIL relevant information Interface with Idox Total Land Charges to enter CIL information in Land Charges Register Generating the required Liability Notices for all CIL chargeable planning permissions Generating CIL Demand Notices for CIL liable development, including calculation of surcharges Generating acknowledgments for the following developer submissions: - Notice of Chargeable Development - Assumption of Liability - Commencement Notice - Withdrawal of Assumption Of Liability - Transfer of Assumed Liability - Claims for Exception or Relief - Payment Receipts Generating Default of Liability Notice Generating Warning Notice Generating Stop Notice Document management of all CIL notices issued and developer submissions received Recording and monitoring of each stage of CIL enforcement for each CIL chargeable development Interface with financial system to record CIL receipts and expenditure Production of reports to monitor CIL collection Monitoring payment plans

I work for Shropshire Council, we are one of the front-runner Council's and are currently implementing CIL. We use the Exacom system which we have found to work really well and is very user friendly. The Exacom Team also offer excellent support if any issues occur during the operation of the system. The Exacom CIL system specifications we use are very similar to that outlined by Lambeth, however the key factor is that all reports are tailored to our needs, and if these change during operation, the Exacom team provide the support required to make amendments. We are also currently looking to introduce the Exacom Project Module, which will increase our ability to make the link between CIL income and delivery of infrastructure. Exacom are also developing a Public Facing Module that will allow project delivery bodies to directly input into the Project Module System, to provide regular updates on project progression. We are also aware that a S106 module is being developed that will allow the Exacom system to consider both CIL monies and S106 monies used to deliver projects either jointly or independently. The Exacom system has really assisted with the implementation of CIL, however whatever approach you take, a good CIL IT package is essential in order to successfully implement and audit the CIL process.

We are using Exacom to administer CIL and find it a very good product. However it doesn't contain a section on the Recovery of CIL ie where in cases of persistent non-compliance, collecting authorities may take more direct action to recover the amount due by using the courts. To satisfy our Debt recover section does anyone know of any instances where the 'court' route was taken, so we can judge whether this would be a likely occurance.

I am aware that Liability Orders applied via the Magistrates' Court has had the desired effect.

I am assuming that these are in instances where development has completed?

We have never got to the Magistrates Court via Reg. 97 (liability order).

We find that in the few instances of persistent non-payment, serving a warning notice (Reg.89) has the desired effect.  We never had to follow up with a CIL Stop Notice (Reg.90) as the Warning Notice was enough to gee up the Developer to pay once they realised we could serve a Notice stopping construction until payment was received (although one did leave it until the day before his deadline issued on the Warning Notice!).
