Boundary Wall whether 1965 permission still extant.

A concrete block boundary wall varying between 9 and 10 feet was granted planning permission in 1965. Some years later the height of the wall was reduced by a couple of blocks which reduced the height of the wall to 2 metres. Now, due to a neighbour obtaining planning permission, the owner of the wall wishes to re-instate the height of the wall. Does he require planning permission? This is the first time I have posted a request for help so I hope you can help me.

I would say that Planning permission would be required to raise the wall height. If the original permission had never been fully implemented (e.g. wall built to only part of the approved height) then in theory it could be built up to the previously approved height at any time, but if the wall was built full height and then subsequently changed (reduced in height) it has been materially altered and so to build it up a second time is a new operation and thus requires permission.
