Appeal on the Grounds of Non-Determination

Working with a client in a London borough where a scheme has been actively worked-up post applicaiton for a period of some two years now. The Council has run out of things to ask clarification on and it seems it just deliberately dragging its feet bumping promises of commmittee dates from month to month now. Presumably they are quietly content in the knowledge that the applicant is effectively out of time to appeal now. Is there an example of a workable solution to appeal on the grounds of non-determination this late on? This is a scheme of much needed housing with a good offer of affordable included- it is hugely frustrating in the current climate of non- delivery and low start on sites that a council can act in such a care-free manner with little regard to their own Strategic Housing Needs Assessment when all they are being asked to do is perform their role as planning authority. Any case law would be much appreciated.

Tim, You can appeal non-determination up to 6 months after either the statutory time frame or such other extended timeframe agreed in writing between the applicant and the LPA. Assuming you aren't currently operating under an agreed extension of time for determination, and assuming that at the moment the possible determination dates are being discussed by phone only, I would suggest that you write a letter asking the LPA to agree in writing to a deadline for determination - this then gets you an extended deadline under the regs which you can then use as a date to appeal non-determination against. Of course the LPA may realise you are out of time to appeal and decline to do this but it's probably your only option at this stage. Actually, your other option is to resubmit the scheme and appeal non-determination as soon as the statutory time frame has elapsed, but this obviously has implications in terms of time and money.
