April 2015 and no CIL in place

All,

Is there anyone out there who has given some thought to how they can work around the pooling restrictions and continue using s106 after April 2015 in the absence of having an adopted CIL in place? Are there any local authorities that have revised their Planning Obligations SPD to take account of this?

Any input would be much appreciated.

The only thing that may be possible is to be much more specific in the wording of any s106 and direct monies towards actual projects as opposed to 'education' or 'open space'. We won't have CIL in place for April either (it's not viable at the moment) but what we have also done is to remove the need for contributions on small schemes for POS etc in line with the new thresholds for affordable housing. This way contributions should be more substantial (schemes of over 10) and it will be easier to identify projects for which the contributions can be pooled; ie getting rid of the really small contributions.
