Non Material Amendment - Free Go

For the purposes of Regulation 9 of The Town and Country Planning (Fees for Applications, Deemed Applications, Requests and Site Visits) (England) Regulations 2012 is an application made under Section 96A of the Town and Country Planning Act (application for a Non Material Amendment) classed as an 'application' for which a free go applies.

The Planning Portal Fee calculator allows selection of this exemption.

Not forgetting that free goes apply only in the case of a refusal or withdrawl of a proposal of similar character.

I am wondering what the circumstances are that prompted your post, David?

Hi Phillipa

Our admin team picked this up because the Planning Portal allows you to select the exemption, we got a NMA application through the Portal which was a first application but showed no fee.

I was wondering why the Portal was allowing this. Is it the case if one was refused they do get a free go.
