Hi, has anyone had the experience of Golden Brick deals and if so, how have you dealt with them regarding the CIL contribution? For anyone that isn't familiar with the term a Golden Brick deal is where a Housing Association buys a development once it gets to foundation or similar trigger point. As all reliefs have to be claimed prior to commencement and CIL is payable upon commencement how would this work where a Housing Association intends to buy an entire development once it reaches foundation level and want to claim the Affordable Housing Relief?? Of course, as with everything, there is no guarantee that they will definitely buy the development.

Hi Rebecca

CIL Regulation 52 deals with this. The original landowner claims the releif prior to commencement and then notifies the charging authority once disposal to the Housing Association occurs.
