My authority granted planning permission for a new dwelling in the countryside a few years ago and as part of it, a condition was imposed (and accepted) requiring the development to be constructed to Code for Sustainable Homes level 6.  The development has not been implemented but the site has changed hands and the new owner has submitted a new application with a slightly different design and layout, which are acceptable.  However, in light of the where the Code for Sustainable Homes appears to be heading and the Deregulation Bill going through Parliament, he does not wish to meet code level 6 but the relevant Building Regulations instead.  Is anybody still using conditions requiring applicants to meet a particular code level or an alternative standard or none at all?  I'd be grateful for any advice or comments.
