Mixed use developments and CIL rates

Hi everyone,

We have a development that is COU to B1/C3 (holiday lets), in our area the B1 is zero rated for CIL but the holiday lets are classed as new dwellings which are rated at £135/sqm - and cannot be self-build.

The agent is saying that there should be no charge at all as mixed use isn't in our charging schedule.

It has also been indicated by the architect that there will no longer be any B1 use - so we decided to charge at the residential rate of £135/sqm.

We have pointed out that if they can prove the existing use of the building then the charge could be reduced to £0 as they are not adding any new floor-space.

Has anyone else had any mixed use permissions? How have you calculated the CIL charge if the different uses have different rates?
