FOI on Member Voting

FOI on Member Voting

A client has asked me if he can FOI a LPA to indicate which way individual members of a development control committee vote. In this council he understands the vote is secret by pressing voting buttons not a show of hands. Would such a request have to be made to the chairperson before a vote was taken and would members have to agree? Or is it the public's right to know how councillors have voted? Anybody help asap.

Hello Rob,

The committee should behave in line with their constitution. Many will not record individual members votes unless is specifically required for a particular reason (usually to do with costs).

So, it may not be possible to respond to an FOI because the information is not held.

Start with the constitution and work back from there would be my advice.
