We have a self builder who submitted all the relevant paper work and commenced their FUL permission earlier this year. However,they did not build to the plan and have had to apply for a S73 half way through construction. The S73 increases the size of the house from the floorspace on the FUL.
Should they receive the new S73 permission I assume we would judge that they have begun a material operation on site as they inplemented the FUL,thus not being aboe to claim self-buuld for the S73 and being chargeable for the whole lot? Atleast that's how I have interpreted the Regs -anyone had this before?
