USE OF CIL TO REPAY LOANS

Hi,

I have been asked by a Parish Council whether they are allowed to use their CIL Meaningful Proportion payments to repay loans specifically taken out to fund infrastructure in the parish.

Regulation 60 only appears to relate to Charging Authoritys.

Please can anyone advise?

We have given thought to this point. Our solicitors view is that it is not possible, currently, to use CIL to pay borrowing costs on loans, but it is possible to use CIL to repay an infrastructure loan that has been taken out by a body that isn’t a charging authority i.e. a parish council
